A Miami-Dade County high school band teacher assigned to the Alonzo and Tracy Mourning Senior High Biscayne Bay Campus has been arrested and charged amid allegations of inappropriate conduct involving students, authorities said.
Jose Francisco Montes-Guedez, 40, was booked on Feb. 13, 2026, in Miami-Dade County on multiple counts, including two counts of offenses against students by authority figures, two counts of battery (touch or strike), and three counts of contributing to the delinquency of a child.
Investigators alleged the case involves three students and includes accusations that range from providing students with vape pens to unwanted physical contact. The investigation began in November 2025, following concerns that surfaced after an incident at the end of the 2024–2025 school year, law-enforcement records show.

Detectives documented separate accounts from students describing different interactions with the teacher. One student reported receiving vape pens and said that, on one occasion, the teacher requested a kiss in exchange for one of the devices. During questioning, the teacher denied criminal intent and described his conduct as providing students with a “safe space,” investigators reported. Authorities also documented admissions that he held confiscated vape pens for a period and that he touched a student’s shoulder, later apologizing after she expressed discomfort.
